A Question of Liberty

I apologize for the late post. The school's server was down all day. Please answer the question below with a thoughtful answer. Please reply by 12:00PM on Sunday 2/3.

Why, if one is concerned with protecting human liberty, would one want to make the legislative branch of government dominant (rather than the executive or judicial)? Are there good reasons why someone concerned with liberty would distrust a strong executive? A powerful judiciary? Is liberty most often threatened by (a) powerful political elites who escape public control or (b) a majority intent on imposing its will on a minority? Which of these cases would lead one to favor a strong legislative branch?

The legistlative branch has more members so it is harder for it to shift to one side or have one opinon. In the executive and judicial branches there are less people making it easier for them to become corrupt and pushing their own agenda without consequences.

Liberty is most often threatened by powerful political elites. Case A would lead one to favor a strong legislative branch.

The legislature should have more power because investing too much power in 1 person (the president, head of exec. branch) is risky, and the judicial branch is not elected by the people. There are always good reasons to distrust a powerful executive (primarily summed up by the saying, "absolute power corrupts absolutely"), and the judiciary branch can be distrusted based on the fact that it's members are depend on others besides the common people for jobs. On a major scale, powerful political elites are more likely to threaten liberty (i.e. Hitler and Caesar, both of which to over a democracy and created something less democratic). This senario favors a strong legislative branch, while the other scenario does happen (a majority in the legislature shutting down the minority)and does not support a strong legislative branch.

The main reason for giving the most power to the legislative branch is because the legislative branch is the only one directly elected by the people. It is also able to represent different groups of people, since it is made up of so many people, unlike the executive and judicial branches. A reason to distrust a strong executive branch is the fear of tyranny. A strong judicial branch would leave a large amount of power in a few peoples’ hands; people who weren’t even elected.
Liberty is threatened by both the political elites who manage to escape common people’s control and the majority oppressing the minority. Pennsylvania’s government under the articles of confederation demonstrates how a popular majority can be tyrannical. Britain shows the other situation.
A strong legislative branch would protect against any political elite from becoming too powerful. Since so many people are elected, there would almost have to be people with conflicting interests. All of these different viewpoints in one branch keep it balanced.
The strong legislative branch could actually make it somewhat easier for a large majority to take over though. If a huge majority was elected, they could overrule the minority since they would have over two-thirds of the vote. With their vast numbers, they would also be able to manipulate the other, weaker branches.

The legislative branch should have the most power do to its representation of the people.There diverse with each being elected to his/her position. This does not affect human liberty. A strong executive power would impose some concern because one can be subject to abuse of power. The judicial branch should not be the dominant power do to the misrepresentation of the people.
Both, Political elites and the majority intent on imposing its will on a minority are subject to threaten liberty, but a political elite is more subject . A strong legislative branch is favored because the diverse opinions of the branch makes it difficult.

It is risky to place a lot of the power into the hands of a single person who may not reflect the views of the general population. This is being compared to the executive and judicial branches which are not made up of a large number of people and are not directly elected by the poeple.
Liberty is often threatened by both of them, political elites and majorities imposing their wills on a minority. They both would favor a strong legislative branch, as it is not as vulnerable to these scenarios because of its make up of elected officials.

In order to protect human liberty it is necessary to have a wide range of people who can make the decisions. The legislative brance has the most members creating difficulty in a shift too far to one side of an opinion. Usually in the legislative brance there are varied decisions and they won't necessarily go against the desires of the general public. People are better represented if there are more opinions on the floor. People concerned with liberty would probably distrust a strong executive government because they might question the intentions of the executive person. The executive branch of government is much smaller, therefore it may not be possible to represent all people's views on an issue. A powerful judicial branch would do just the same. The smaller brances of government aren't as representative of the people being represented as are the representatives in the legislative brances because they are coming directly from the people to those positions of power. Liberty is most often threatened by political elites are more often going to threaten liberty even though a majority intent on imposing its will on a minority does just the same. It is just more evident and subject on the political elite side. The political elites would definately lead one to favor a strong legislative branch.
